SB1310 Summary

• Amends the Oklahoma Computer Crimes Act (21 O.S. 2011, Sections 1952-1958) to expand the definition of "access" to include personal accounts and other accounts, not just computers and computer networks.

• Expands prohibited conduct to include unauthorized access to or use of personal accounts and other accounts, making violations apply to social media, email, and similar digital accounts.

• Broadens civil liability provisions allowing victims to sue for compensatory damages including personal account compromise, and expands prima facie evidence standards for proving willful violations.

• Clarifies that causing access to computer systems or accounts from one jurisdiction to another is deemed personal access in each jurisdiction for purposes of civil and criminal actions.

• Effective date of November 1, 2012.
