SB 1313 Summary

• Permits parties or attorneys to serve process and legal documents via commercial courier service, overnight delivery service, or other reliable personal delivery services as an alternative to certified mail, with written or electronic receipt required showing delivery details and recipient signature.

• Allows any person 15 years of age or older who resides at the defendant's dwelling or usual place of abode to accept service on behalf of the defendant, with a presumption that return receipts signed at a residence were signed by a qualifying resident.

• Enables acceptance of service at registered offices or principal places of business by any officer or employee authorized to or regularly receiving certified mail on behalf of entities, with a presumption that return receipts signed at such locations were signed by an authorized employee.

• Specifies that all deadlines based on service using these alternative methods shall be calculated the same as if service had been by mail.

• Exempts filing of documents with court clerks, which remains governed by Oklahoma Statutes and court rules; effective November 1, 2012.
