SB1371 Summary

• Amends 36 O.S. 2011, Section 1126 to clarify that confidentiality protections for actuarial reports and work papers in the Insurance Commissioner's possession are limited to documents actually held by the Commissioner, not identical or related documents held elsewhere.

• Modifies 36 O.S. 2011, Section 1219.4 regarding discount medical plan organizations to restrict who can publicly disclose examination work papers and confidential information, limiting public disclosure authority to the Insurance Commissioner only.

• Amends 36 O.S. 2011, Section 1443 on Third-party Administrators to clarify that confidential work papers from Commissioner examinations cannot be made public by the Commissioner or any person who obtained information during the examination, except as specifically provided in the statute.

• Amends 36 O.S. 2011, Section 1509.1 to limit disclosure of confidential work papers and materials to the Insurance Commissioner only, with protection from discovery by subpoena limited to documents actually in the Commissioner's possession.

• Effective date: November 1, 2012.
