Requires all liability insurance policies issued in Oklahoma to include provisions protecting injured persons even if the insured becomes bankrupt or insolvent.

Grants injured persons, survivors, or heirs the right to sue the insurer directly within policy limits, without first obtaining a judgment against the insured.

Allows direct action against the insurer alone when the insured is bankrupt, insolvent, cannot be served, is an uninsured motorist carrier, or is deceased.

Applies to accidents or injuries occurring in Oklahoma regardless of where the insurance policy was written or whether it contains anti-direct action clauses.

Effective date: November 1, 2012.
