SB 1377 Summary

• Creates authorization for injured persons and heirs to sue motor vehicle liability insurance companies directly, regardless of where the policy was issued.

• Applies to all policies covering liability from negligent operation of motor vehicles as defined in Oklahoma Statutes Title 36, Section 3635.

• Insurance company consent to direct action lawsuits is automatic upon policy issuance or delivery, even if the policy contains provisions prohibiting such actions.

• Direct action lawsuits are permitted only if the accident or injury occurred within Oklahoma.

• Effective date: November 1, 2012.
