SB 1386 Summary

• Establishes a Medicaid fraud control unit within the Office of the Attorney General to investigate suspected Medicaid fraud cases referred by the Oklahoma Health Care Authority.

• Permits the Attorney General to pursue Medicaid fraud cases independently without referral from the Oklahoma Health Care Authority if credible evidence of fraud exists.

• Grants the Attorney General access to all records held by Medicaid providers and the Oklahoma Health Care Authority for fraud investigations, including the ability to issue subpoenas and take sworn statements.

• Creates the "Attorney General's Medicaid Fraud Revolving Fund" to receive fines, penalties, and recovered funds, with amounts exceeding 50% of operating costs distributed to the General Revenue Fund (75%) and Attorney General's Evidence Fund (25%).

• Effective date: November 1, 2012.
