Nursing facilities and specialized facilities without emergency power generators or written disaster plans must provide written disclosure to residents or their caregivers upon admission stating the facility lacks either a generator or disaster plan.

All nursing facilities, assisted living centers, residential care homes, and specialized facilities must have an emergency evacuation plan coordinated with local emergency management agencies and filed with the State Department of Health.

The State Board of Health may promulgate rules to implement disclosure requirements and enforcement provisions related to emergency preparedness.

Amends the Home Care Act to prohibit licensed health care facilities, physicians, advanced practice registered nurses, physician assistants, and state agency employees from referring clients for personal care services or companion/sitter services except to licensed agencies.

Effective date: November 1, 2012.
