SB 1406 Summary

• Amends 10 O.S. 2011, Section 7700-204 to add an exception to presumption of paternity based on military deployment.

• A man shall not be presumed the father of a child if he presents Department of Defense documentation proving he was not physically present during the child's conception period.

• Preserves all existing presumptions of paternity (marriage, marriage termination, invalid marriage, post-birth marriage with assertion, or cohabitation with child).

• Allows this exception to be used as a rebuttal to presumed paternity, consistent with Article 6 of the Uniform Parentage Act.

• Effective date: November 1, 2012.
