SB 1472 Summary

• Requires state-chartered retirement plans (OPERS, OTRS, OSLERF, OPPRF, OFPRF, OWCRS, and Judges/Justices system) to provide requested information to the Oklahoma Department of Human Services for establishing, modifying, or enforcing child support orders.

• Mandates that retirement plans provide participant information including names, addresses, telephone numbers, social security numbers, employment, compensation, and benefits data within 30 days of the first written request, then monthly thereafter.

• Requires retirement plans to honor Income Assignments issued by the Department as the sole form of Qualified Domestic Relations Order needed to intercept and pay child support obligations, with the Department receiving first priority over all other creditors.

• Allows retirement plans to submit required data electronically or through other authorized means; protects plans from liability when disclosing information or taking actions in good faith to comply.

• Effective date: November 1, 2012.
