Creates the "Worker Classification Act" establishing definitions and requirements for classifying workers as employees or independent contractors in Oklahoma's construction and trucking industries.

Defines an independent contractor as someone performing labor under contract who is not subject to the payer's control over methods and manner of work, except regarding job results.

Requires individuals engaged in construction/trucking work to sign sworn affidavits declaring their classification status as employees or independent contractors, submitted monthly to the Department of Labor.

Establishes that independent contractors must maintain liability insurance and injury protection coverage; failure to do so constitutes prima facie evidence of misclassification and subjects violators to administrative fines up to $1,000.

Creates criminal penalties including misdemeanor charges for false affidavit information and fraudulent worker misclassification, with fines up to treble the amount of unpaid benefits and withholdings, effective November 1, 2012.
