Summary of SB 1520

• Requires individuals receiving workers' compensation disability benefits to file annual affidavits under penalty of perjury with the Workers' Compensation Court, certifying they remain unemployed and unable to work, and that income sources have not changed.

• Failure to file the required annual affidavit results in automatic suspension of benefits and creates a rebuttable presumption for benefit termination unless the person proves by preponderance of evidence their continued unemployment and inability to work.

• Allows the Workers' Compensation Court to find changes in condition "for better or for worse" and amend prior orders related to temporary total disability, permanent partial impairment, permanent total disability, and medical benefits.

• Makes technical corrections to references within the Workers' Compensation Code, updating statutory section numbers.

• Becomes effective November 1, 2012.
