SB1716 Summary

• Creates new misdemeanor offense for maliciously and knowingly cutting or damaging fences used for production or containment of cattle, bison, horses, sheep, swine, goats, domestic fowl, exotic livestock, exotic poultry, or game animals without good cause.

• Establishes enhanced penalties for second or subsequent offenses, making them felonies punishable by up to $1,000 fine and/or up to 2 years imprisonment in state penitentiary.

• Requires property loss or damage to the fence to constitute an offense.

• Codifies new criminal statute as Section 1791 of Title 21 of Oklahoma Statutes.

• Effective date: November 1, 2012.
