SB 1760 Summary

• Amends 21 O.S. 2011, Section 1321.4 regarding prohibited acts during a declared state of emergency under the Oklahoma Riot Control and Prevention Act.

• Prohibits the Governor from restricting the sale, ownership, possession, transportation, carrying, transfer, and storage of firearms, ammunition, and ammunition accessories that are otherwise legal under state law during a state of emergency.

• Allows individuals harmed by violations of the firearms restriction prohibition to seek legal relief and recover costs and reasonable attorney fees in district court.

• Permits seizure or confiscation of firearms in violation of these protections to be challenged through an action for return in the district court of the county where the individual resides or where the firearm is located.

• Becomes effective November 1, 2012.
