Amends 47 O.S. 2011, Section 7-116 to add exceptions to the damage limitation provisions for uninsured motorists.

Removes the limitation on pain and suffering damages when: defendant was driving under the influence (if convicted or if DUI can be proven by preponderance of evidence); plaintiff was a passenger (unless also owner); plaintiff was not in any vehicle involved; or the accident involved a wrongful death claim.

Adds exceptions for intentional accidents, hit-and-run situations, accidents committed during felony offenses, and situations involving dependent minors whose parents lacked insurance.

Provides two additional exceptions: when prior insurance was terminated without 30 days' notice for non-payment, and when an uninsured vehicle operator lacked actual or constructive knowledge the vehicle was uninsured.

Effective date: November 1, 2012.
