SB 1831 Summary

• Modifies Oklahoma's offer of judgment procedure (12 O.S. 2011, Section 1101.1) by changing how offers and counteroffers are made and accepted in civil litigation.

• Eliminates the requirement to file offers of judgment with the court; instead, defendants must now directly deliver offers to plaintiffs, and plaintiffs must serve responses on defendants rather than filing them with the court.

• Removes the $100,000 threshold requirement for when offer of judgment provisions apply, making them available for actions of any amount.

• Revises attorney fee and cost recovery provisions for parties who reject offers or counteroffers that are more favorable than the final judgment awarded.

• Effective November 1, 2012 for all civil actions filed after that date.
