SB1861 Summary

• Amends the Standards for Workplace Drug and Alcohol Testing Act (40 O.S. 2011, Section 560) to permit employers to release drug and alcohol test records in response to valid judicial or administrative orders.

• Maintains existing protections requiring written permission from the employee/applicant before employers can release test records, except when compelled by court or administrative order.

• Preserves employee access rights to their own test results and prohibits testing facilities from disclosing unrelated health information to employers.

• Effective date: November 1, 2012.
