SB 1862 Summary

• Renames the "Elevator Safety Act" to the "Elevator Safety and Inspection Act" and transfers regulatory authority from solely the Department of Labor to a shared responsibility between the Department of Labor and the Insurance Department

• Establishes new license categories including elevator endorsements to professional licenses, licensed elevator mechanics, and elevator inspectors, with requirements for appropriate education, qualifications, and experience to ensure elevator safety and code compliance

• Requires all elevators subject to the act to obtain liability insurance coverage and undergo registration and annual inspection; creates certificates of operation and temporary operation certificates as proof of compliance

• Grants the Department of Labor and Insurance Department authority to promulgate rules, conduct inspections, issue licenses and endorsements, and enforce compliance; allows contracted private inspectors to perform inspections

• Effective date of November 1, 2012; includes provisions for emergency temporary permits and exemptions for certain elevators in federal buildings, private residences, and industrial facilities
