SB1946 Summary

• Amends 21 O.S. 2011, Section 1289.25 to expand legal protections for use of defensive force in homes, businesses, and vehicles against unlawful intruders

• Establishes presumption of reasonable fear of death or great bodily harm when using defensive force if intruder was unlawfully, deceptively, or forcefully entering or had unlawfully, deceptively, or forcibly entered a dwelling, residence, occupied vehicle, or place of business

• Grants immunity from criminal prosecution and civil action for persons using justified force; requires courts to award attorney fees and expenses if defendant found immune from prosecution

• Applies presumption of unlawful intent to persons who unlawfully or forcefully enter dwellings, residences, occupied vehicles, or places of business

• Effective date: November 1, 2012
