SB 228 Summary

• Amends Oklahoma Agricultural Code Section 3-82 to establish new procedures for filing damage claims against pesticide applicators for harm to growing crops or plants

• Requires complainants to file a written complaint with the Department within 90 calendar days of alleged damage or before 25% of damaged crops are harvested, whichever occurs first

• Mandates complainants allow the applicator and their representatives (crop consultants, insurers, bondsmen) reasonable access to inspect and sample allegedly damaged crops during ordinary business hours

• Bars any person who fails to comply with complaint filing and inspection requirements from filing a lawsuit for damages against the applicator

• Requires the Board to notify the complaint filer and the accused applicator within 2 working days of receiving a complaint, and notify the complainant in writing within 7 working days after resolution
