ENGROSSED HOUSE BILL NO. 1050 - Summary

• Amends 22 O.S. 2011, Section 60.4 relating to the Protection from Domestic Abuse Act and protective orders.

• Changes the renewal time period for protective orders from twenty (20) days to sixty (60) days with a new hearing date assigned until the defendant is served.

• Requires courts to schedule full hearings on domestic abuse petitions within twenty (20) days (or seventy-two (72) hours if a minor child has been removed from the residence).

• Establishes that protective orders issued on or after November 1, 2012 shall be for a fixed period not exceeding five (5) years, unless extended based on specific findings of defendant's history of violating court orders, prior violent felony convictions, or prior stalking convictions.

• Becomes effective November 1, 2013.
