HB 1069 Summary

• Amends 43A O.S. 2011, Section 3-452 to remove the requirement that defendants pay for alcohol and drug substance abuse courses or treatment programs "at their own expense" when a sentence is suspended.

• Modifies 47 O.S. 2011, Section 11-902 regarding driving under the influence convictions to allow payment for required assessment and evaluation fees to be made by the defendant or a third party without state-appropriated funds.

• Recognizes successful completion of Department of Corrections-approved substance abuse treatment programs as satisfying requirements for ten-hour or twenty-four-hour alcohol and drug courses or treatment programs.

• Allows payment for assessment, evaluation, and treatment programs to be made by third parties on behalf of defendants, provided no state funds are used.

• Effective date: November 1, 2013.
