ENR H.B. 1241 Summary

• Amends 21 O.S. 2011, Section 1401 relating to arson in the first degree by removing references to manufacturing or attempting to manufacture controlled dangerous substances from the general definition of arson.

• Creates a new subsection (B) establishing a separate crime of arson in the first degree specifically for persons manufacturing, attempting to manufacture, or endeavoring to manufacture controlled dangerous substances in violation of Title 63, Section 2-401(G) who burn or destroy buildings or injure persons.

• Maintains criminal penalty structure for both arson offenses: fines not to exceed $25,000 and/or imprisonment in the custody of the Department of Corrections for not more than 35 years.

• Clarifies the scope of arson charges by separating methamphetamine lab-related fires from general arson prosecutions while maintaining equivalent penalties for both.

• Effective date: November 1, 2013.
