HB 1250 Summary

• Amends the Protection from Domestic Abuse Act to authorize courts to order defendants to wear active, real-time GPS monitoring devices as part of protective orders or restraining orders.

• Court may allow victims to monitor defendant location, including receiving alerts when defendant comes within specified distance of victim, upon victim request.

• Court must find by preponderance of evidence that defendant has history of violence or is likely to commit violence against victim before ordering GPS monitoring.

• Court may order defendant, victim, or both to pay costs and expenses related to GPS monitoring device and service.

• Requires review hearings upon request of either party to determine if GPS monitoring order remains necessary; effective date November 1, 2013.
