HB1260 Summary

• Amends 63 O.S. 2011, Section 2-101.2 regarding the Uniform Controlled Dangerous Substances Act by expanding the definition of "glass or metal tube" to include both glass and metal materials used for drug-related purposes.

• Prohibits retailers in Oklahoma from offering glass or metal tubes for retail sale to patrons, defining retailers as businesses primarily engaged in selling consumable goods and services to the general public (excluding specialized laboratory equipment sellers).

• Establishes criminal penalties for violations: misdemeanor punishable by not less than 6 months incarceration and/or fines of not less than $2,500.

• Exempts the sale of cigars packaged by manufacturers in glass or metal containers when the primary purpose is facilitating cigar sales rather than prohibited drug use.

• Becomes effective November 1, 2013.
