HB 1336 Summary

• Amends 22 O.S. 2011, Sections 991a-17 and 991a-20 relating to the Elderly and Incapacitated Victim's Protection Program to update language and modify penalties

• Increases mandatory minimum jail time from 30 days to 90 days for first convictions involving elderly or incapacitated victims, which cannot be suspended, probated, or deferred

• Allows the 90-day minimum to be served in county jail as part of a suspended or deferred sentence and permits night or weekend incarceration options

• Requires courts to impose restitution for victim expenses, community service, or both as part of sentencing for crimes against elderly or incapacitated persons

• Effective date: November 1, 2013
