HB 1389 Summary

• Amends 11 O.S. 2011, Section 21-103 to allow cities and towns to annex adjacent territory without notice and public hearing requirements if all property owners in the territory provide written consent.

• Maintains existing requirements for annexation without unanimous owner consent, including publication of notice in newspapers, mailing notice to property owners, and holding a public hearing 14-30 days after notice.

• Requires municipalities annexing territory without unanimous consent to prepare a service plan detailing how municipal services (water, sewer, fire, law enforcement) will be extended and implemented within a specified timeframe.

• Preserves protections for agricultural land, including exemptions from certain municipal ordinances for properties 5+ acres used for agriculture and detachment procedures if services are not substantially completed within the prescribed timeframe.

• Becomes effective November 1, 2013.
