ENGR. H. B. NO. 1415 Summary

• Creates the "Modernization of Agency Creation Process and Sunrise Act" establishing requirements that no profession or occupation be regulated by the state unless necessary to protect public health, safety, or welfare from significant harm.

• Requires all bills proposing creation of new state agencies ("sunrise bills") to be printed with an SR number and can only be introduced in odd-numbered years during regular legislative sessions, with passage limited to even-numbered years.

• Mandates legislative committees spend at least 12 months evaluating sunrise bills by considering five factors: potential harm from unregulated practice, specialized skill requirements, job creation effects, alternative protections available, and cost-effectiveness of regulation.

• Requires proponents to provide detailed written information to committees including number of affected individuals, documentation of public harm, comparison to other states' regulations, and cost analysis of proposed regulation.

• Effective November 1, 2013.
