HB 1431 - Electronic Resource Act of 2013

• Enacts the Electronic Resource Act of 2013 and establishes the State Governmental Technology Applications Review Board to review state governmental Internet-based electronic and online transactions.

• Board composition includes the Director of the Office of Management and Enterprise Services, four state agency representatives (at least one from law enforcement), and four non-state employees appointed by legislative leadership.

• Board members serve two-year terms without compensation but receive travel reimbursement and must select a chair from their membership.

• Board duties include reviewing convenience fees for electronic transactions, monitoring state portal systems, approving the Chief Information Officer's technology plan, approving service charges to agencies, and developing performance metrics for state services.

• Adds new duty requiring board approval of a plan by public elementary and secondary schools to recover costs of instructional technology resources issued to students.

• Effective July 1, 2013, with emergency clause for immediate effect upon passage and approval.
