HB 1487 Summary

• Prohibits state agencies, government subdivisions, their employees, and members of Oklahoma's National Guard from knowingly aiding federal armed forces in detaining any Oklahoma citizen under Title 50, Section 1541 of the United States Code (National Defense Authorization Act for Fiscal Year 2012, Section 1021).

• Creates new Section 3120 of Title 74 of the Oklahoma Statutes codifying the prohibition, applicable only when such assistance would place state entities or personnel in violation of the U.S. Constitution, Oklahoma Constitution, Oklahoma Statutes, legislative acts, or Oklahoma Administrative Code rules.

• Exempts state and local law enforcement, the Military Department, Army National Guard, and Air National Guard from the prohibition when participating in joint task forces or cooperative agreements with federal law enforcement that are not specifically for the purpose of carrying out the detentions described in the act.

• Effective date: November 1, 2013.
