• Removes the exemption for mine pit water use in sensitive sole source groundwater basins, making such mines subject to state water regulations and Oklahoma Water Resources Board rules.

• Requires mining operators to adopt and implement monitoring plans by January 1, 2014, and file quarterly reports and annual reports documenting pit water accumulation and disposition.

• Establishes that mining operators must comply with augmentation and water management requirements unless they can demonstrate the groundwater use is offset by stream flow augmentation, will not reduce natural springs/streams, or acquire sufficient groundwater rights within 90 days.

• Defines "consumptive use" as groundwater diverted from mine pits that is not returned to the groundwater basin, mine pit, holding basin, or definite stream, including moisture content in mined material and evaporation exceeding precipitation.

• Declares an emergency clause for immediate implementation upon passage and approval.
