HB 1635 Summary

• Establishes a recall process allowing qualified electors to remove elected state and county officials from office before their term ends through a petition and election process.

• Requires recall petitions to be signed by 15% of votes cast in the last general election for the office being recalled, contain a statement of 200 words or less explaining grounds for recall, and be circulated for 90 days.

• Provides that recall petitions for state officials are filed with the Secretary of State Election Board, while county official recalls are filed with the county election board secretary.

• Mandates the recalled officer cannot be eligible as a candidate in the successor election, and successor candidates must meet standard filing requirements per Title 26 of Oklahoma Statutes.

• Does not apply to municipal officers or school board members; prohibits recall petitions until an officer has served 12 months and limits to one recall petition per term; effective November 1, 2013.
