HB 1760 Summary

• Requires applicants for newly drilled or converted commercial injection/disposal wells and land application sites to submit information on impacts to health, safety, and road conditions within two miles of the proposed facility.

• Directs the Department of Transportation and county commissioners to review applications and determine whether proposed roads and bridges can support the wells without substantial detriment; applicants may upgrade or pay for road improvements if needed.

• Prohibits the Corporation Commission from issuing permits until the Department and county commissioners substantiate via resolution that roads can be used safely or the applicant agrees to necessary upgrades.

• Prevents operation of wells or sites until required road improvements are completed; establishes a 45-day response period for Department and county officials, with failure to respond deemed approval.

• Grants applicants the right to trial de novo review in district court if aggrieved by Department or county board decisions; effective July 1, 2013.
