HB 1763 Summary

• Changes Military Department state employees from unclassified to classified service status, making them subject to Oklahoma Personnel Act provisions for appointments, promotions, adverse actions, and personnel matters.

• Authorizes the Adjutant General to require National Guard membership as a special requirement for certain positions requiring military training, command authority, direct military programs, or functions related to National Guard administration, training, or facility/equipment maintenance.

• Designated positions must specify the required military grade or grades authorized by the Adjutant General for appointment and continued employment.

• Employees in designated positions who are separated from the National Guard or lose the required military grade will be reclassified, promoted, demoted, transferred, or separated according to Oklahoma Personnel Act and Merit Rules for Employment.

• Permits the Adjutant General to grant leave to state civilian employees consistent with federal workforce rules in support of the National Guard; effective November 1, 2013.
