HB 1768 Summary

• Modifies 27A O.S. 2011, Section 2-6-403 regarding sewage treatment system requirements for residential and small public systems

• Allows property owners installing on-site sewage treatment systems with absorption fields of 300-500 feet (instead of the required 500+ feet minimum) to avoid penalties if they file a variance notice with the county clerk and submit a file-stamped copy to the Department of Environmental Quality

• Exemption does not apply if the Department has a record of a previously malfunctioning system on the property; owners must upgrade to a compliant system if the undersized system fails

• Changes minimum residential lot size requirement from 2.5 acres to 2 acres for plats outside municipal corporate limits when no lot is within 300 feet of a public water supply source

• Effective date: November 1, 2013
