HB1835 Summary

• Amends the Uniform Controlled Dangerous Substances Act (63 O.S. Section 2-402) to modify penalties for possession of controlled substances

• Increases penalties for Schedule I and II drug possession on first offense from a range ending at 10 years to maintain 2-10 years, and on second offense increases from up to 20 years to minimum 4 years up to 20 years

• Maintains misdemeanor penalties for Schedule III, IV, or V substances, marijuana, and excepted preparations at up to 1 year imprisonment and $1,000 fine

• Creates felony penalties for second or subsequent violations of Schedule III-V substance possession occurring within 10 years of a prior sentence completion, with imprisonment of 2-10 years and $5,000 fine

• Effective November 1, 2013
