HB 1882 Summary

• Creates the Space Flight Liability and Immunity Act in Oklahoma law, codifying new sections 351-353 of Title 3 of the Oklahoma Statutes.

• Provides immunity from civil liability for space flight entities for participant injuries resulting from inherent risks of space flight activities, provided participants have been informed of risks and given informed consent.

• Limits immunity exceptions to cases where the space flight entity commits gross negligence evidencing willful or wanton disregard for participant safety, or intentionally causes injury.

• Requires space flight entities to have participants sign a specific warning statement acknowledging understanding of space flight risks, informed consent, and voluntary participation; failure to comply prevents the entity from invoking immunity protections.

• Effective November 1, 2013.
