HB 1990 Summary

• Creates the Department of Real Estate Services within the Office of Management and Enterprise Services to replace the Construction and Properties Division, with a State Facilities Director as chief administrative officer.

• Expands the Department's authority to perform procurement actions for state agencies including selecting construction managers and consultants, issuing solicitations, and managing construction contracts for projects subject to the Public Facilities Act.

• Increases the emergency contract threshold from $15,000 to $50,000 for construction manager and consultant services when declared necessary by the Department and agency leadership.

• Authorizes the Department to issue statewide contracts for managed construction services, provide facility management and operations services to state agencies on a cost-recovery basis, and authorize exemptions for agencies meeting specified standards.

• Removes the requirement for the State Construction Administrator to file annual reports on construction management projects and becomes effective November 1, 2013.
