HB 2015 Summary

• Amends the Individual Abortion Form (63 O.S. 2011, Section 1-738k) to add questions about reasons for abortion, fetal tissue examination, sex determination, ultrasound procedures, and fetal heartbeat disclosure requirements.

• Requires physicians to ask pregnant women seeking abortion to provide reasons for the procedure unless a medical emergency exists, with specific checkbox options covering socioeconomic, health, and other circumstances.

• Mandates collection of ultrasound images with redacted patient names as attachments to abortion forms, subject to HIPAA regulations rather than Oklahoma Open Records Act.

• Expands the Annual Abortion Report (Section 1-738m) to include detailed statistics on reasons for abortion, ultrasound usage, sex-selective abortion data, fetal heartbeat disclosures, and hospital privileges of performing physicians.

• Allows registered voters and resident taxpayers to institute legal proceedings against abortion providers who fail to submit required reports if the State Commissioner of Health refuses to do so within 20 days of written demand, with attorney fees awarded to prevailing parties.

• Effective date: November 1, 2013.
