HB2018 Summary

• Amends 75 O.S. 2011, Section 308 regarding the Administrative Procedures Act to require legislative approval of all rules adopted by state agencies.

• Changes rule approval process: instead of rules automatically taking effect after 30 legislative days without disapproval, all rules now require affirmative approval by joint resolution of the Legislature.

• Rules submitted on or before April 1 are approved only if the Legislature fails to disapprove within 30 legislative days (or if adjourned before expiration); rules submitted after April 1 require affirmative approval by the Legislature during regular session.

• Rules may be disapproved in whole or in part by concurrent resolution without Governor approval; agencies cannot resubmit identical disapproved rules except within first 60 calendar days of next regular session.

• Becomes effective November 1, 2013.
