ENR HB 2055 - Administrative Procedures Act

• Changes the expiration date for emergency rules from July 14 to September 14 following the legislative session in which they are promulgated.

• Establishes an omnibus joint resolution process for legislative approval of proposed permanent rules filed by April 1, with all rules approved except those specifically disapproved by the Legislature.

• Allows the Governor to declare rules approved and finally adopted if the omnibus joint resolution fails to pass or has a technical defect, provided the Governor publishes the declaration by July 17.

• Modifies the definition of "finally adopted rule" to include rules approved through the omnibus process, by Governor declaration, or by joint resolution, in addition to requiring joint resolution approval rather than concurrent resolution for rule disapproval.

• Creates new Section 308.3 enabling agencies to petition the Governor for approval of rules not approved by the Legislature, with the Governor able to approve rules if the agency demonstrates necessity and proper authority.
