• Requires each public school district to establish a summer breakfast or lunch food service program by January 15, 2014 for schools where at least 85% of students qualify for free or reduced-price meals and the school operates a summer program.

• Summer food service programs must be implemented by summer 2014 and operate for the duration of each qualifying school's summer session, funded by federal funds, commodities, and available state and local resources.

• Allows school districts to petition the State Superintendent of Public Instruction by January 15 for an exemption if the program's costs cannot be fully covered by reimbursement, requiring a public hearing and written decision by March 1.

• Permits school districts and residents to appeal the State Superintendent's decision; if the appeal is granted, the district is relieved of the requirement; if denied, the district must implement the program the following summer.

• Becomes effective November 1, 2013.
