HB 2114 Summary

• Amends the Unfair Sales Act (15 O.S. 2011, Section 598.1) to consolidate and restate prohibitions on unfair pricing practices in commerce

• Makes it unlawful for any person to sell goods at prices lower than available to competitors for the purpose of destroying competition or eliminating a competitor

• Prohibits discriminatory pricing transactions where discounts, rebates, allowances, or advertising service charges are granted to purchasers in excess of those available to competitors on goods of like grade, quality, and quantity

• Establishes penalties of up to $5,000 in fines or up to one year imprisonment for violations

• Repeals 15 O.S. 2011, Sections 598.2 through 598.11; effective date November 1, 2013
