Amends 36 O.S. 2011, Section 6515 to allow small employer health insurance carriers to include an employer's bona fide wellness program (including tobacco cessation programs) in premium rate development.

Amends 40 O.S. 2011, Section 500 to permit employers to offer incentives to employees who participate in wellness programs, including smoking cessation programs, in conjunction with employer-provided health insurance.

Maintains existing protections prohibiting employers from discriminating against employees based on tobacco use during non-working hours or requiring tobacco abstinence as a condition of employment.

Becomes effective November 1, 2013.
