HB 2231 Summary

• Requires the Office of Management and Enterprise Services to develop and maintain a mobile application for emergency preparedness, response, recovery, and mitigation information, administered by the Chief Information Officer and associated with www.emergency.ok.gov.

• Creates the Oklahoma Disaster Relief Materials Price Stabilization Act prohibiting retailers and wholesalers from charging excessive prices (exceeding 110% of the highest price charged in the previous 30 days) for disaster relief materials during extreme temporary conditions lasting seven (7) days or less.

• Prohibits selling disaster relief materials below cost with intent to injure competitors or substantially lessen competition, with exceptions for charitable sales, government contracts, clearance sales, and auction sales.

• Establishes civil penalties up to $1,000 per violation, allows private causes of action for damages and injunctive relief, and protects civil defendants and witnesses from criminal prosecution based on testimony in civil proceedings.

• Becomes effective November 1, 2013.
