HB2237 Summary

• Amends Oklahoma mechanics' and materialmen's lien laws (42 O.S. 2011, Sections 142, 142.6, 143, and 150) to modify filing procedures and requirements for construction liens.

• Reduces the deadline for filing lien statements from four (4) months to ninety (90) days after the date materials or equipment was last furnished or labor was last performed.

• Establishes pre-lien notice requirements that claimants must send to owners and original contractors within seventy-five (75) days of last supplying materials, services, labor, or equipment, with limited exceptions and specific notification methods (hand delivery, certified mail, or automated transaction).

• Removes certain pre-lien notice exceptions and adds a requirement that claimants file a notarized affidavit verifying compliance with pre-lien notice requirements when filing their lien statement.

• Becomes effective November 1, 2013.
