SB 1034 Summary

• Amends 10A O.S. 2011, Section 1-6-102 to establish confidentiality protections for child welfare case records, including juvenile court records, agency records, district attorney records, Court Appointed Special Advocate (CASA) records, law enforcement records, education records, and social records.

• Adds Court Appointed Special Advocate (CASA) records pertaining to child welfare cases to the list of confidential records that cannot be inspected or disclosed without a court order.

• Establishes procedures for accessing safety analysis records in child custody or visitation proceedings, requiring a parent, legal guardian, or child to file a motion and obtain a court order with protective conditions limiting disclosure to necessary parties.

• Requires the Department of Human Services to have a minimum of five (5) judicial days to produce court-ordered safety analysis records and prohibits all subpoenas for such records without a court order.

• Becomes effective November 1, 2013.
