SB 1035 Summary

• Amends 22 O.S. 2011, Section 513 to expand the types of criminal pleas available from four to six.

• Adds two new plea options: (2) guilty with court approval of an agreed sentence reached by the state and defendant, with the court able to reject but not modify the agreement; and (6) a blind guilty plea where the court determines sentencing pursuant to applicable law.

• Modifies the Alford plea (guilty while maintaining innocence) to require district attorney recommendation and court approval, and clarifies it is now option 4 instead of option 3.

• Maintains existing pleas: not guilty, nolo contendere, and former judgment of conviction or acquittal.

• Effective date: November 1, 2013.
