SB 1090 Summary

• Amends the definition of "judgment" in Oklahoma workers' compensation law to include final determinations by administrative law judges and the state-designated workers' compensation administrative agency, in addition to court judgments.

• Grants exclusive jurisdiction to administrative law judges and the workers' compensation administrative agency (absent appeal) over all workers' compensation actions against Oklahoma counties, cities, towns, school boards, and other municipal subdivisions.

• Requires administrative law judges and the workers' compensation administrative agency to provide certified copies of administrative judgments and determinations to judgment creditors without cost, similar to existing requirements for court clerks.

• Modifies notification requirements so judgment creditors must transmit copies of administrative decisions to municipal officers including the clerk or secretary, treasurer, and county excise board secretary.

• Effective date: November 1, 2013.
