Senate Bill 217 Summary

• Amends 63 O.S. 2011, Section 2-201 to grant the Director of the Oklahoma State Bureau of Narcotics and Dangerous Drugs Control authority to classify new, noncontrolled products with abuse potential as controlled dangerous substances by rule.

• Requires notice and hearing before classification, with rules submitted to the Legislature during the next regular session; rules remain in effect unless disapproved by concurrent resolution.

• Establishes nine criteria for determining whether to recommend or issue orders for substance control, including abuse potential, pharmacological effects, abuse patterns, public health risk, and whether the substance has been scheduled under federal law.

• Clarifies that the Board of Pharmacy or the Director may conduct hearings, and requires orders to be provided to the Chairs of the Judiciary Committees of the Oklahoma State Senate and House of Representatives.

• Excludes over-the-counter substances and distilled spirits, wine, malt beverages, and tobacco from control authority; effective November 1, 2013.
