SB 25 Summary

• Amends 27A O.S. 2011, Section 2-10-802 to clarify application of disposal fees for non-hazardous solid waste accepted at sites or facilities with permits issued by the Department of Environmental Quality.

• Requires landfill disposal sites and commercial incinerators to install and maintain scales to weigh waste received, with scales certified by the State Board of Agriculture; allows volume-based estimates if scales are inoperable.

• Establishes disposal fees: sites receiving less than 100 tons per day pay $1.50 per ton (retaining $0.50 per ton for capital improvements); sites receiving more than 100 tons per day pay $1.50 per ton (retaining $0.25 per ton) until capital costs of $40,000 are recouped, then fees reduce to $1.25 per ton.

• Imposes the fee on all non-hazardous solid wastes and requires quarterly reporting of tonnage and fees collected to the Department of Environmental Quality within 30 days of quarter end.

• Declares an emergency, making the act effective immediately upon passage and approval.
